SwingCheck — Terms and Conditions

1. What SwingCheck is

SwingCheck is a golf practice aid. It estimates body positions from your phone's camera and gives feedback against general ranges and your own mobility results. It is not a substitute for lessons from a qualified coach, and it is not medical, physiotherapy or health advice.

2. Accuracy

Measurements come from a camera and a body-tracking model and are approximate. Lighting, distance, camera angle, clothing and phone placement all affect them. Treat the numbers and scores as a guide, not a fact. Scores out of 10 are our own weighting of those measurements against general target bands and your mobility results, not a standard or a rating recognised by any golf body. Features marked beta (currently club path and lag, estimated from hand movement) are experimental and may be unreliable. The app cannot see your clubface, ball flight or strike and makes no claims about them.

3. Your safety

You are responsible for using the app safely — in particular for where you put your phone, for having room to swing, for people and property around you, and for stopping if anything hurts. Consult a doctor or physiotherapist before following any movement advice if you have an injury or condition.

4. AI coach

Comments from the AI coach are generated automatically from your measurements and may be wrong or unhelpful. They are general practice suggestions only. You can turn the AI coach off at any time in Profile.

5. Free trial and subscription

Free trial. New subscribers get the first 30 days free. You will not be charged during the trial.
Price. After the trial, the subscription is A$9.99 per month including GST, unless we tell you about a price change in advance. If we change the price, we'll email you at least 30 days before it applies, and you can cancel before then.
Billing. Payments are processed by Square under its own terms. We don't see or store your card number. Your subscription renews automatically each month on the same date until you cancel.
Cancelling. You can cancel at any time from the link in your Square receipt or by emailing us. Cancellation takes effect at the end of the current billing period; you keep access until then. Cancel before the trial ends and you pay nothing.
Refunds. Because you can try everything free for 30 days, we generally don't refund monthly charges once made, other than as required by the Australian Consumer Law (see section 9). If something's gone wrong, email us — we're reasonable people.
Failed payments. If a payment fails, Square will retry. If it still fails, access may be paused until the payment goes through.
One subscription, one household. A subscription covers use on the devices you own or control. Several players can use one phone. Please don't share your access with people outside your household.

6. Licence

We grant you a personal, non-transferable licence to use the app on devices you own or control, subject to these terms. Don't copy, modify, reverse-engineer, resell or use the app to build a competing product. The SwingCheck name, the MyVanguard name and the wolf mark are ours.

7. Availability

The app is delivered over the internet and the AI coach depends on third-party services; either may be unavailable at times. The app falls back to built-in feedback when the coach is unavailable. We may change, add or discontinue features with reasonable notice where practical. If we discontinue the service entirely, we'll refund any unused part of the current month.

8. Acceptable use

Don't use the app for anything unlawful, don't try to overload or interfere with the service, and don't attempt to extract the coaching service's prompts, models or keys. We may suspend access that breaches these terms.

9. Australian Consumer Law

Nothing in these terms excludes guarantees you have under the Australian Consumer Law. Beyond those guarantees, and to the extent the law allows, we are not liable for loss or damage arising from use of the app, and our liability is limited to re-supplying the service or refunding what you paid for it.

10. Privacy

Our Privacy Policy explains what the app and this website process. In short: video stays on your phone; the optional AI coach sends only numbers; Square handles your payment details.

11. Changes and law

We may update these terms. We'll post the new version here with a new effective date and, for material changes, email subscribers. Continued use after an update means you accept it. These terms are governed by the laws of [New South Wales], Australia, and you agree to the non-exclusive jurisdiction of its courts.
